Terms of Use

The rules that apply to everyone who uses Moviie: from play to playback end. Written to be read, not just signed.

01Definitions and scope of the service

This is a convenience translation. In case of any discrepancy, the Portuguese version prevails.

These Terms of Use ("Terms") govern access to and use of Moviie: a suite for hosting, processing, and distributing videos, with Artificial Intelligence (AI) features and related services (streaming, APIs, players, integrations). By creating an account, accessing, or using Moviie, you fully agree to these Terms and to the referenced Policies (Privacy Policy, Cookies Policy, Acceptable Use Policy: AUP, SLA, and DPA/Data Processing Addendum, where applicable).

Platform / Service
Moviie's infrastructure, web applications, APIs, SDKs, players, and features.
Customer
A legally capable individual or a legal entity that contracts, accesses, or uses the Platform.
Operators / Team
Accounts linked to the Customer, under the Customer's responsibility.
Customer Content
Videos, audio, images, text, metadata, viewer data, catalogs, knowledge bases, and other materials uploaded, stored, processed, or distributed through the Platform.
AI Models / Agents
AI features (Moviie or third-party) that generate, transcribe, dub, index, categorize, or transform Content.
Personal Data
As defined in Law No. 13.709/2018 (LGPD).
Policies
Supplementary documents bound to these Terms (Privacy, Cookies, AUP, SLA, DPA).
Important scope. Moviie is a hosting and distribution service and is not a permanent archiving/backup service for originals. Technical copies and derivative versions may be created, kept, or discarded solely to enable the service.

02Acceptance, updates, and term

Use implies full acceptance of these Terms. If you do not agree, do not use the Service.

Moviie may update the Terms and Policies at any time. Material changes will be communicated by reasonable means (dashboard, email, or website). If you do not agree, you may cancel within 10 (ten) days; continuing to use implies agreement.

Specific documents (SLA, DPA, product addenda, and pricing) may supplement or prevail when so indicated.

03Registration, account, and eligibility

  1. Accurate registration and a valid payment method are required when applicable.
  2. The Service is intended for individuals over 18 years of age; minors only with the assistance/consent of their legal guardian, who assumes responsibility.
  3. The Customer is fully responsible for its credentials and for the accounts of its Operators, including unauthorized use.
  4. Moviie may refuse, suspend, or cancel accounts for fraud, breach of these Terms/Policies, judicial/administrative order, or risk to operations.
Moviie will never ask for your password through unofficial channels. Single point of contact: support@moviie.ai.

04License to use the platform

We grant the Customer a limited, non-exclusive, non-transferable, and revocable license to use the Platform in accordance with these Terms. Features may be modified, replaced, or discontinued at any time, with no obligation to indemnify, subject to applicable legal and contractual obligations.

05Customer content, licenses, and backups

The Customer retains ownership and intellectual property rights over its Content.

During the term, the Customer grants Moviie a worldwide, non-exclusive, royalty-free license to store, technically reproduce, transcode, encrypt, package, distribute, display, and stream the Content to viewers/end users, as well as to generate technical derivations (multiple resolutions, HLS/DASH, thumbnails, subtitles, transcriptions) strictly for the provision of the service.

Model improvement (opt-in): only with the Customer's express consent may we use anonymized samples of Content and telemetry to train/evaluate our own models; the Customer may revoke this at any time (prospective effects). By default, we do not use Customer Content to train third-party models.

The Customer represents that it holds the rights and authorizations required over all Content and will indemnify Moviie against third-party claims (see Clause 15).

Backups and "master" copies

  • Customer responsibility: to keep backups of the original files (master/source) outside the Platform.
  • No permanent custody: Moviie is not obligated to keep the "master" on a permanent basis; it may not store it after generating the distribution versions, or keep it temporarily or indefinitely, solely to enable the Service: not as an archiving service.
  • No indemnification for the absence of the original: except for a specific legal requirement or an express contractual obligation, the absence of the original file at Moviie does not give rise to any duty to indemnify/restore.

06Acceptable use (AUP) and prohibited content

It is prohibited, among others, to: violate copyright, trademark, image, or privacy rights; host illicit, fraudulent, defamatory, hateful, extremely violent, or non-consensual sexualized content, child exploitation, weapons/explosives instructions, advocacy of terrorism, fraud/scams, disinformation intended to deceive; circumvent DRM/controls; perform hacking, mass scraping, or unauthorized scans; send SPAM; or violate applicable laws (Marco Civil da Internet: Brazilian Internet Civil Framework, LGPD, Copyright Law, Consumer Protection Code, and sector regulations).

Live streams and atypical traffic may require prior approval and technical/commercial adjustments. Moviie may technically monitor abuse and adopt rate-limiting, blocks, content removal, or account suspension for stability and security.

07AI: notices and restrictions

  • AI outputs may contain errors or biases; the Customer must validate them before publishing/using them.
  • It is prohibited to use AI for automated decisions with significant legal impact without human review; for medical, legal, or financial diagnoses; or to violate third-party rights or circumvent copyright/DRM.
  • The fee for implementing agents/knowledge bases may be charged based on volume/complexity and is non-refundable after execution.
  • Messaging integrations (e.g., WhatsApp/Meta) require compliance with the provider's policies; bulk messaging/SPAM is prohibited.

08Plans, pricing, billing, and taxes

  • Prices may change with reasonable prior notice, taking effect from the following cycle.
  • Unless otherwise stipulated, billing is prepaid and, as a rule, non-refundable (without prejudice to the right of withdrawal under Article 49 of the Consumer Protection Code, when applicable to individual consumers).
  • Renewal is automatic at the end of the term until cancellation.
  • Upgrades are prorated; downgrades take effect in the next cycle.
  • Add-ons and overages (bandwidth, storage, and one-off services) follow the current price table; downloads via links/player/API and reprocessing count toward consumption.
  • Moviie's technical measurement prevails for billing.
  • Taxes: prices may not include taxes/charges; the Customer is responsible for the taxes of its operation.
  • In case of default, features may be suspended and the account canceled if the default persists.

09Limits, fair use, and overages

The Customer must manage its contracted limits. Overages may be billed post-paid and/or throttled; in severe cases, Moviie may suspend traffic, without this constituting a service failure. Moviie provides alerts and reports but does not manage the Customer's consumption.

10SLA and availability

We will use commercially reasonable efforts for continuous availability. Service levels and credits are set out in the SLA; credits are the sole remedy for covered unavailability.

Maintenance windows, force majeure, third-party provider failures, the Customer's network, or embed errors do not give rise to credits outside the SLA.

11Privacy, LGPD, and security

The processing of Personal Data follows our Privacy Policy and the LGPD (Brazilian General Data Protection Law, Law No. 13.709/2018). As a rule, the Customer is the Controller of its end users' data and Moviie is the Processor; for the Customer's own data (billing, access), Moviie acts as Controller.

The legal bases include contract performance, legitimate interest (assessed), legal obligation, and consent when required. Data subject rights (confirmation, access, correction, deletion, portability, withdrawal of consent, and review of automated decisions) may be exercised through support@moviie.ai.

Security: we adopt reasonable technical and administrative measures (encryption in transit, access control, logical segregation, and logs). Incidents will be notified to the Customer and to the authorities when required by law, within reasonable timeframes. A DPA may be executed when necessary to detail instructions and controls.

12Reports, takedown, and rights notices

Reports and notices (copyright, privacy, etc.) must be sent to support@moviie.ai.

Flow: receipt → assessment → precautionary removal when applicable → notice to the Customer → up to 10 (ten) days to respond → decision. Repeat offenses or serious violations may result in suspension/termination without refund.

Copyright notices must contain identification of the work, the URL of the material, contact details, good-faith/accuracy statements, and an electronic signature. The Customer may submit a counter-notice with grounds and evidence.

13Cancellation, termination, and effects

By the Customer: cancellation at any time via support@moviie.ai; charges continue until the end of the current cycle.

By Moviie: we may terminate or suspend for breach of these Terms/Policies, judicial order, fraud, operational risk, or repeated default.

Post-cancellation: access is revoked. We keep the video assets for 10 (ten) days so the Customer can download/back them up, unless a different legal obligation applies. Moviie may not have the original "master" (see Clause 5). After this period, the content may be permanently deleted, with no possibility of restoration. Logs and necessary data may be retained for the legal period.

14Third parties, integrations, and dependencies

The Service may depend on third-party providers (CDN, cloud, AI, messaging, payments). We are not liable for failures exclusively attributable to such third parties, but we will make mitigation efforts. Integrations with third-party platforms require compliance with those third parties' policies.

Delegated partner access: when you connect your account to a partner platform, you authorize Moviie to allow that platform to act on your behalf within the limits of the scopes shown and accepted at authorization time (for example, to upload, organize, and publish your videos). You remain responsible for actions taken under that authorization and may revoke it at any time in your account settings; revocation does not affect operations already completed. Billing remains direct between you and Moviie, not intermediated by the partner.

15Indemnification

The Customer will indemnify, defend, and hold Moviie, its officers, employees, and partners harmless against all claims, losses, costs, and expenses (including attorneys' fees) arising from:

  • Customer Content;
  • misuse or breach of these Terms/Policies;
  • violation of third-party rights;
  • unauthorized use by Operators;
  • non-compliance with applicable laws.

16Limitation of liability

To the maximum extent permitted by law, Moviie will not be liable for lost profits, loss of revenue/business, loss of data, downtime, or indirect, special, incidental, punitive, or consequential damages.

To the maximum extent permitted by law, Moviie's total aggregate liability for damages directly arising from the Service will be limited to the amount actually paid by the Customer in the 12 (twelve) months immediately preceding the event that gave rise to it.

Nothing in these Terms excludes liabilities that cannot be excluded by law. Where the Consumer Protection Code applies, this clause will be interpreted in accordance with its rules.

17Moviie's intellectual property

Moviie (and its licensors) hold all rights to the Platform, trademarks, logos, code, interfaces, design, documentation, and know-how. It is prohibited to remove rights notices, perform reverse engineering, or create derivative works.

18Compliance, anti-corruption, and sanctions

The Customer represents that it observes applicable anti-corruption laws (Law No. 12.846/2013 and others) and is not on any sanctions lists. Moviie may suspend or terminate the Service in case of violation.

19Final provisions

  • Assignment: the Customer may not assign these Terms without prior written consent; Moviie may assign them in the context of corporate reorganization.
  • Notices: will be made via the registered email or through the dashboard; single point of contact for the Customer: support@moviie.ai.
  • Severability: the eventual invalidity of one provision does not affect the others.
  • No waiver: tolerating a breach does not imply a waiver.
  • Entire agreement: these Terms and the bound Policies constitute the entire agreement.
  • Governing law and venue: Brazilian law applies; the courts of the District of Niterói/RJ are elected, with waiver of any other.
  • Electronic signature: acceptance logs and the electronic signature have full legal validity.

20Appendices

Appendix A: AUP (summary)

Prohibited: illicit content; child exploitation; hate/discrimination; extreme violence; illegal pornography; weapons/explosives instructions; fraud/scams; copyright/privacy violations; spam; unauthorized scans; DRM bypass. Measures: rate-limiting, blocking, removals, suspension/termination.

Appendix B: AI guidelines (summary)

Opt-in for model improvement; opt-out at any time; prior validation of outputs by the Customer; transparency to the end user when there is AI-generated content.

Appendix C: Retention and deletion

10-day window after cancellation for downloads; after that, permanent deletion. The original "master" may not be stored by Moviie (see Clause 5). Logs and invoices follow the legal periods. LGPD requests are handled in accordance with the law.
